我国现行的法律、法规和规章当中关于中药知识产权的保护问题,涉及到专利法、中药品种保护条例以及新药保护和技术转让的规定,本文通过对上述规范性文件的对比分析,提出了其中存在的问题和解决的途径。

The protection of intellectual property right of traditional Chinese medicine, which is provided in the laws, rules and regulations in force in China, involves the patent law, the regulations for the protection of the varieties of Chinese materia medica and the rules for the protection of new Chinese drugs and their technology transfer. This article puts forward the problems existing therein and proposes the approaches to their resolution through the comparison and analysis of the normalized documents mentioned above.
