通过调查,揭示了目前我国中医药企业工业产权的基本状况,对存在的问题进行了分析。指出:我国中医药企业的工业总产值呈逐年增高的趋势,工业产权的数量也迅速发展,但两者在总体上联系不紧密,其发展关系不相一致; 我国中医药企业无论在规模、知识产权意识和运用能力、研发投入、创新政策、市场保护、中介服务等方面还存在着对中医药知识产权创造、利用、管理、保护不利的一面,需要在政策上予以适当调整。

The paper makes a review of the development of intellectual property in China's TCM industry,and associated problems. Author believes that China's TCM industry has enjoyed a sustained annual increase of its total output, and so has the number of intellectual properties the industry has produced.Unfortunately, the two are not closely associated, nor well matched. China's TCM industry has something obviously not in line with the creation,utilization, management, and protection of TCM IP,in terms of the industry's scale, IP awareness and application, R&D expenditure, policies, market protection, and intermediary service. This means a tailored policy is needed for a better TCM IP management.
