对外资自由利用我国的优势中药材资源,利用其在资本和技术上的优势摘取中医药技术成果,利用我国法律上的空白不当占有中医药既有智力成果和利用中医药治未病的优点抢占医疗器械市场的现象进行了剖析。提出我国中医药领域的对外技术合作要根据自身的特点制定药材资源和知识产权的保护政策,慎重鼓励和吸引外资,防止投资形式铁渗透等,保护国内医药传统医药知识不被外国廉价或无偿使用或占有。

Expanded international TCM cooperation has allowed foreign investors to take full advantage of TCM resources. Such activities could,if not properly regulated,lead to an illegal usurp of intellectual properties derived from the past TCM studies and practice.This paper discusses TCM related intellectual property issues,and proposes to protect TCM intellectual property through enhancing people's awareness.
